Background
Since 1989, Barbee & Associates, Inc. has specialized in representing panel trustees, receivers, debtors, creditors, creditors committees, and liquidating trustees primarily in the Southern District of Florida and the Southern District of New York. The Firm also provides litigation support services regarding business valuation, calculation of economic damages, forensic accounting, divorce, and computer forensics.
The Firm is an Employee Owned Company whose experienced staff includes Certified Public Accountants (CPA’s), Certified Insolvency and Restructuring Advisors (CIRA’s), and a staff member Accredited in Business Valuations (ABV). Members of the firm have presented at Region 21 Trustee Association and National Association of Bankruptcy Trustees (NABT) seminars.
Experience
The Firm has significant experience representing receivers, appointed at the request of the Securities and Exchange Commission (SEC), and bankruptcy trustees in investment fraud and ponzi scheme cases. Members of the firm have provided expert testimony regarding – lost profits, avoidable transfers, solvency / insolvency, business valuation, ponzi schemes, tracing proceeds, constructive trust, substantive consolidation / piercing the corporate veil, equitable distribution of assets in dissolution of marriage, and determination of viability of continued operations.
The Firm routinely prepares preference analyses, evaluates defenses to preferences, analyzes transfers to insiders, analyzes tax implications of sales and reorganizations, conducts investigative accountings, performs forensic analysis of computerized files, evaluates issues related to substantive consolidation, analyzes proofs of claims, compiles Debtor in Possession operating reports, and prepares liquidation analyses.
